Reparación Posterior a La Condena

El procedimiento de alivio posterior a la condena (a menudo denominado moción 3850 o moción 3.850) es un procedimiento penal por el que un delincuente condenado puede solicitar que se corrija o anule una condena o sentencia. Este procedimiento está concebido como un sustituto parcial del habeas corpus, en el que el Tribunal revisa las alegaciones de un delincuente condenado de que se violaron sus derechos constitucionales.

Reparación posterior a la condena

La ley federal relativa a este procedimiento es 28 U.S.C. §2255, promulgada por el Congreso en 1948.
