 <h3 class="wp-block-heading">What is an Injunction?</h3>
 <p>An injunction is a court order that prohibits someone from doing something. In domestic violence, an injunction is a “restraining order” – a legal order issued by a judge that requires one person to stop harming another.</p>
 <h3 class="wp-block-heading">Can it Help Protecting Me?</h3>
 <p>If you are a victim of domestic violence, an injunction can provide much-needed protection from your abuser. It can order the abuser to stay away from you, your home, your workplace, and your children’s school. It can also order the abuser to surrender any firearms and to have no contact with you.</p>
 <h3 class="wp-block-heading">Types of Injunctions</h3>
 <p>There are different types of injunctions depending on the relationship between the victim and the abuser.</p>
 <p>A <strong>dating violence injunction</strong> Florida protects victims of dating violence from their abusers.</p>
 <p>In Florida, dating violence is “between individuals who have or have had a continuing and significant relationship of a romantic or intimate nature.” To get a dating injunction, you must be able to show that your abuser has committed dating violence against you.</p>
 <p>A <strong>sexual injunction</strong> provides legal protection for victims of sexual violence. Sexual violence is any form of unwanted sexual contact, including rape, fondling, and sexual assault.</p>
 <p>A <strong>repeat injunction</strong> is an order issued after someone who had a conviction of a crime against you. It is important to note that a repeat injunction is only issued if there is evidence that the abuser is likely to commit another crime against you.</p>
 <p>In a Florida <strong>domestic violence injunction</strong>, the abuser must be a family or household member. Family or household members include spouses, ex-spouses, parents, children, relatives, and people currently or previously living together.</p>
 <h3 class="wp-block-heading">Injunction Process in Florida</h3>
 <p>If you are a victim of domestic violence, you can go to your local courthouse and file a petition for an injunction. The clerk will then give you a hearing date. At the hearing, you must present evidence to the judge that the abuser has committed domestic violence against you.</p>
 <p>If the judge finds enough evidence to issue an injunction, they will issue a temporary injunction. The temporary injunction will be in effect until the abuser can respond to the allegations against them.</p>
 <p>The judge can make the injunction permanent if the abuser does not respond to the allegations. If the abuser does react to the claims, both parties will have a chance to present evidence at a final hearing.</p>
 <p>At the final hearing, the judge will decide whether to make the injunction permanent or to dismiss it.</p>

 <p>Today the United States Government is presented with the silent presence of “domestic terrorists,” The Sovereign Citizens Movement. This movement was founded in 1970 upon the anarchist belief that they are not subject to any federal, state or municipal statutes. Their purpose is to wage war against the government and other forms of authority using “paper terrorism” harassment and intimidation tactics, and occasionally resorting to violence. For instance, this group has been known to commit acts of fraud in in various courts, and with governmental licenses and paperwork, leading to frequent confrontations with various law enforcement officials.</p>
 <p>As this group continues to grow they are trying to infect the United States Judicial System. A member of this group, Anthony Williams, calling himself a “Private Attorney General,” has been attempting to act as an attorney for a numerous defendants throughout the United States. However, Mr. Williams has neither attended law school, nor has he been admitted by the Board of Bar Examiners to practice law. When asked by Judges if he is an attorney Mr. Williams will argue his position with irrelevant and contradictory case law. This attempt to erode judicial principles and values is causing a mockery within the court system, as Mr. Williams continues his attempt to practice law without any form of legal education or certification and without prosecution. Furthermore, if this conduct is not stopped not only will the courts be subject to unnecessary delays and confusion, but common citizens looking for help will be subject to the harm and injustice our legislatures and government has worked so hard to prevent.</p>

 <p>Bruce Jorgensen was arrested on January 28, 2016, at the Miami International Airport for the offense of desertion of a child and held on $1 million dollars bond with multiple conditions, i.e., electronic ankle monitor, daily report to Pre-Trial Services, fully collateralize bond, and surrender passport. Upon my office’s investigation and presentation of evidence to the Court and the state prosecutor contradicting every allegation of the Plantation Police Department, Mr. Jorgensen’s bond was reduced to $5,000. On March 1, 2016, the Broward County State Attorney’s Office declined to file any criminal charges against Mr. Jorgensen based on evidence presented. Aage Jorgensen is still missing. His father has set up an email address for people to email tips with information about Aage – <a href="/cdn-cgi/l/email-protection#bcf4d9d0cc88dddddbd9fcdbd1ddd5d092dfd3d1">[email protected]</a>. He is also offering a reward of $5,000 for information that leads to Aage’s whereabouts.</p>

 <h2 class="wp-block-heading">Have you ever heard of the Florida Sunshine Law?</h2> <p><strong>Have you ever heard of the Florida Sunshine Law?</strong></p>
 <p>Passed in 1967, it requires that all meetings of any state, county, or municipal board or commission be open to the public, and mandates that any official action taken at the closed meeting not be binding. Fla. Stat. sec. 286.011 (1995).</p>
 <p><strong>But who can really understand that?</strong></p>
 <p>In layman’s terms, it is meant to allow the public access, either at meetings or via recordings, to information ensuring an honest, competent and responsive government.</p>
 <p>In this case, my client was accused of allegedly violating this Sunshine Law.</p>
 <p>My Client, Mr. L was interested in becoming chair of his City Parks and Recreation Advisory board and contacted another board member to nominate him. He was subsequently nominated and elected to the position.</p>
 <p>A fellow board member, also interested in the position, felt that my client violated the Sunshine Laws by contacting another board member to solicit the nomination before the government meeting and thus filed a claim with the prosecutor.</p>
 <p>I believe under the First Amendment, my client is allowed to communicate with a fellow board member to talk about his nomination and there was never any intention on his part to violate the Florida Sunshine Law. We believe this investigation will end with the case being dismissed.</p>

 <h2 class="wp-block-heading">Glenn Roderman’s take on the Bill Cosby case.</h2> <p>It’s hard not to turn on the news and hear a broadcast with something new regarding Bill Cosby’s legal issues. It’s also hard to imagine that “Mr. Pudding Pop” and the ultimate family man could assault more than 50 women.</p>
 <p>The issue of sexual assault stirs up a lot of emotions, are usually very complex, and often hard to prove. In addition, the cases against Mr. Cosby are more controversial than most cases of this type.</p>
 <p>One of his many accusers, Andrea Constand, age 43, alleges that in 2004 Mr. Cosby drugged her and sexually molested her. After a 10-year civil case, the same alleged victim settled for an undisclosed sum.</p>
 <p>In 2015, the <em>Constand v Cosby</em> case was reopened when a judge in Montgomery County, PA, ruled at a preliminary hearing that there is sufficient evidence for prosecutors to proceed with their case against Mr. Cosby.</p>
 <p>Regardless of the Statute of Limitations or the verbal immunity deal that allegedly occurred between Mr. Cosby and the previous District Attorney, the sealed testimony in the civil case could possibly be used in the criminal case.</p>
 <p>The current prosecutor claimed in a public arena that, if he was elected District Attorney, he would prosecute Cosby to the fullest extent of the law.</p>
 <p>Many criminal defense attorneys, like myself are very interested in how this case progresses through the Philadelphia court system because so many issues could be appealed down the “blind road of justice”.</p>

 <h2 class="wp-block-heading">FLORIDA’S ORDERS OF PROTECTION</h2> <p>Do you know about the five orders of Protection Against Violence in Florida?</p>
 <p>I Wanted to let people know about the five orders of Protection Against Violence in Florida. Restraining orders or better known as Injunctions are court ordered in Florida for Domestic Violence, Repeat Violence, Dating Violence, Sexual Violence and Stalking should be pursued vigorously if you, a family member, a friend, or neighbor are experiencing any one type of this violence. Upon presenting the Court with an application for a Temporary Restraining Order, even if it is ex parte, “without notifying the other party whom it is against” the Court will grant that Temporary Restraining Order if there appears to the Court that there is “an immediate and present danger” of harm existing. There is no requirement in Florida for you to provide the Court with any police reports, photographs of injuries, or other supporting evidence to get the Temporary Restraining Order. Thereafter, usually within 2 weeks, the Court will set a full evidentiary hearing wherein testimony of the parties and evidence will be considered by the Court before it will consider granting a Permanent Restraining Order against the other party. The standard of proof upon which the Court makes its decision is by a “preponderance of the evidence”.</p>
 <p>I presently have a Restraining order case in 3 of the five categories previously mentioned.</p>
